SPARE PARTS AND ACCESSORIES

The following conditions of sale apply to all transactions carried out by the company in the absence of a specific contract expressly stipulating the points on which the company accepts a derogation. The placing of an order implies their acceptance by the customer notwithstanding any reservations or requirements that may accompany it.

ORDERS :

Your orders can be sent by mail, fax, to our agents or by phone. They must include as much information as possible (exact description of the parts in our catalogue). We will send to the address you have given us, all the items on your order, except those that are not available on the day of processing.



PRICES :

Our prices and quotations are based on prices excluding VAT on the date of the quotation and are subject to any increases that may occur before the goods are delivered. Unless otherwise stipulated, our prices are exclusive of tax, ex works. Packaging, transport and insurance costs, customs duties or any other incidental expenses shall be borne by the buyer.

INVOICES :

Our invoices are payable net, by cheque, bank transfer or accepted draft, on the due date specified on the invoice.

WARRANTY :

Only the components of the appliance are covered by the warranty, not the components of those components. Parts must be returned complete to qualify for a warranty exchange. Parts returned under warranty will be shipped prepaid.



RETENTION OF TITLE CLAUSE:

The equipment remains the property of TPS3 SARL until the buyer has made full payment (law 80.335 of 12 May 1980).

SHIPMENT - TRANSPORT :

Our goods, whatever the terms of delivery and collection, travel at the buyer's risk (even in the case of carriage paid). The products shipped are not insured by our company. It is the buyer's responsibility to check the shipments upon arrival. In the event of delay, damage or shortages, the consignee must take recourse against the carrier. Unless otherwise stipulated, packaging is never taken back by our company.



CLAIMS :

In order to be valid, any claim must reach us within eight days of the date of arrival of the goods at destination.

LATE PAYMENT :

In the event of late payment, the buyer shall automatically incur default interest equal to the legal interest rate, increased by 0.7 points.



PENALTY CLAUSE - DISPUTES :

In the event of a dispute of any nature whatsoever, jurisdiction is expressly assigned to the Commercial Court of NANTES, regardless of the conditions of purchase, the method and place of payment accepted, even in the event of a guarantee appeal or multiple defendants. The rights and obligations of the parties are governed exclusively by French law.

GENERAL :

As some parts may still be under development, they are not included in the price list. The contents of the catalogue are subject to change without notice.
